Welcome to ReApply. These terms govern your use of our AI-powered career intelligence platform.

1. Agreement to Terms

By accessing or using ReApply ("Service"), operated by ReApply (a DBA of 1123IT, LLC) ("we," "us," "our"), you agree to these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the Service.

1.1 Age Requirements

• You must be at least 16 years old to use ReApply
• If you are under 18, you must have parent or guardian consent
• By using the Service, you represent that you meet these requirements

1.2 Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email and on-site notification. Continued use after changes constitutes acceptance.

2. Description of Service

2.1 What ReApply Provides

ReApply is an AI-powered career intelligence platform that:

• Analyzes job postings using semantic understanding (AI Job Parser)
• Researches companies automatically (Company Research Engine)
• Assesses your fit for specific roles (Gap Analysis Engine)
• Generates custom resumes and cover letters (Strategic Material Generator)
• Provides strategic insights and positioning recommendations

2.2 What ReApply Does NOT Provide

• Job Guarantees: We cannot guarantee you will receive job offers, interviews, or employment
• Job Applications: We do not submit applications on your behalf
• Information Fabrication: We never invent experience, skills, or qualifications you don't have
• Legal Advice: Career guidance is informational, not legal or professional advice
• ATS Bypassing: We optimize for ATS compatibility, not circumvention or deception

3. User Accounts and Responsibilities

3.1 Account Creation

• Provide accurate, current information during registration
• Maintain account security and keep credentials confidential
• You are responsible for all activity under your account
• Notify us immediately of unauthorized access: support@reapply.app

3.2 Your Responsibilities

Accuracy of Information:

• Provide truthful, accurate career information (resume, skills, experience)
• Do not fabricate qualifications or misrepresent your background
• You are solely responsible for the accuracy of information you provide to employers

Review AI Output:

• All AI-generated content must be reviewed and edited by you before use
• Verify that resumes and cover letters accurately represent your qualifications
• AI may make mistakes - you are responsible for final content accuracy

Compliance with Laws:

• Use the Service only for lawful job-seeking purposes
• Comply with all applicable employment and discrimination laws
• Do not use the Service to engage in fraud, deception, or illegal activity

3.3 Prohibited Uses

You agree NOT to:

• Create false or misleading career profiles
• Use the Service to spam employers or submit fraudulent applications
• Reverse engineer, scrape, or extract data from the platform
• Share your account with others or create multiple accounts to circumvent limits
• Use the Service for competitive intelligence or to build a competing product
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users or our team
• Violate any laws or third-party rights

4. Pricing and Payment

4.1 Credit-Based Pricing

ReApply uses a credit-based pricing model. One credit = one job application.

Free Credits:

• New users receive 3 free credits upon account creation
• Free credits are a one-time offer and do not replenish
• Free credits never expire

Credit Packs:

• Starter Pack: 10 credits for $10 ($1.00 per credit)
• Value Pack: 20 credits for $18 ($0.90 per credit, save 10%)
• Pro Pack: 50 credits for $40 ($0.80 per credit, save 20%)

4.2 How Credits Work

Credit Consumption:

• One credit is consumed when you create an application
• Credits are consumed immediately upon application creation, regardless of whether you generate optional documents (resume or cover letter)
• You cannot recover or refund a credit once an application has been created

What's Included With Each Credit:

• Automatically Provided: AI job parsing, comprehensive company research, strategic gap analysis, cultural fit assessment, ATS optimization, and detailed job insights
• Optional Features: Custom resume generation and personalized cover letter (you choose whether to generate these documents)
• Important: One application = one credit, whether or not you use the optional resume and cover letter features

4.3 Credit Expiration and Rollovers

• Credits Never Expire: All purchased and free credits remain in your account indefinitely
• Use credits at your own pace - no time pressure or monthly resets
• Credits are tied to your account and cannot be transferred to other users

4.4 Payment Processing

• All payments processed securely through Stripe
• We do not store your credit card information on our servers
• Payment is required before credits are added to your account
• Credits are added to your account immediately upon successful payment

4.5 Refund Policy

No Refunds on Credit Purchases:

• Since credits never expire, we do not offer refunds on credit pack purchases
• You can always use your credits whenever you're ready - they'll be waiting for you
• Exception: If you believe you were charged in error, contact support@reapply.app within 7 days of the charge
• Fraudulent chargebacks may result in account suspension and legal action

4.6 Price Changes

• We may change credit pack pricing at any time with reasonable notice
• Price changes only affect future purchases - credits you've already purchased remain valid
• Current credit pack prices are displayed at http://reapply.app/pricing

5. Intellectual Property

5.1 Your Content

You Own Your Data:

• You retain all rights to your resume, career information, and personal data
• You grant us a limited license to process your data to provide the Service
• This license ends when you delete content or close your account

AI-Generated Content:

• You own all resumes, cover letters, and materials generated for you
• AI output is based on your input and tailored to your applications
• You may use, modify, and distribute generated content as you see fit

5.2 Our Platform

ReApply Retains All Rights To:

• The ReApply platform, website, and technology
• Our AI prompts, algorithms, and intelligence engines
• Trademarks, logos, and branding
• Documentation, training materials, and user guides

5.3 No Training on Your Data

• We do NOT use your data to train AI models
• We do NOT share your data with AI providers for model training
• Your career information remains confidential and is used only to serve you

6. Privacy and Data Protection

Your privacy is governed by our Privacy Policy. Key points:

• We never sell or share your data for marketing purposes
• Data is encrypted in transit and at rest
• You can export or delete your data anytime
• Company research is cached 72 hours, then automatically purged
• Resumes and cover letters retained for 1 year after last modification

7. Disclaimers and Limitations

7.1 Service Provided "As Is"

ReApply is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of AI output
• Uninterrupted or error-free operation
• Results, job offers, or career outcomes

7.2 AI Limitations

Important Notice: AI technology has limitations:

• AI may generate inaccurate, incomplete, or misleading content
• You MUST review and verify all AI-generated materials before use
• We are not responsible for errors in AI output that you fail to catch
• AI cannot replace human judgment in career decisions

7.3 No Employment Guarantees

• ReApply does not guarantee interviews, job offers, or employment
• Career success depends on many factors beyond our control
• Use of our Service does not create an employment relationship with us

7.4 Third-Party Services

• We use third-party AI providers (Anthropic, OpenAI) and payment processing (Stripe)
• We are not responsible for third-party service failures or downtime
• Your use of third-party services is subject to their terms

8. Limitation of Liability

To the maximum extent permitted by law:

ReApply (1123IT, LLC) and its officers, employees, and contractors shall NOT be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from AI errors or inaccuracies you fail to correct
• Employer decisions, rejections, or hiring outcomes
• Unauthorized access to your account due to your failure to secure credentials
• Third-party service failures (AI providers, payment processors)

Maximum Liability: Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless ReApply (1123IT, LLC), its officers, employees, and contractors from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the Service or AI-generated content
• Inaccurate or false information you provide to employers
• Your violation of any law or third-party rights
• Unauthorized use of your account due to your negligence

10. Account Termination

10.1 Termination by You

• Delete your account anytime from Settings > Account > Delete Account
• Cancel subscription before deleting account to avoid future charges
• Data will be permanently deleted within 30 days of account closure

10.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our policies
• Engage in fraudulent or abusive behavior
• Fail to pay for services
• Create risk or legal liability for us

We will provide notice and opportunity to remedy violations when possible, except in cases of serious abuse or legal risk.

10.3 Effect of Termination

• Access to the Service immediately revoked
• Outstanding payments become immediately due
• You may export your data before termination (after termination, data is deleted)
• Provisions regarding indemnification, liability, and dispute resolution survive termination

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.

11.2 Informal Resolution

Before filing a claim, contact us at legal@reapply.app to attempt informal resolution. Most disputes can be resolved this way.

11.3 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in Spokane County, Washington, under the American Arbitration Association (AAA) rules, except:

• Small claims court (under $10,000) may be used instead
• You may opt-out of arbitration within 30 days of account creation by emailing legal@reapply.app

11.4 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or consolidated proceeding, unless you opt out of arbitration as described above.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ReApply.

12.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

12.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

12.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms to a successor or acquirer.

12.5 Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control (natural disasters, war, pandemics, internet outages, third-party service failures).
